Conditions

APV art. 2:7 (Voorwerpen op, boven, in of aan een openbare plaats in strijd met de publieke functie ervan) is a general rule without a vergunning: using the road is forbidden only when the use damages the road, obstructs the road or its management, fails reasonable welstand requirements; an ontheffing of the bevoegd bestuursorgaan is then needed.

Het is verboden een openbare plaats of een gedeelte daarvan anders te gebruiken dan overeenkomstig de publieke functie daarvan, … Het bevoegde bestuursorgaan kan ontheffing verlenen van het verbod in het eerste lid.
