APV art. 2:5 (Het plaatsen van voorwerpen op, aan of boven een openbare plaats in strijd met de publieke functie ervan) is a general rule without a vergunning: using the road is forbidden only when the use damages the road, endangers the use of the road, obstructs the road or its management, causes nuisance, fails reasonable welstand requirements; an ontheffing of the bevoegd bestuursorgaan is then needed.
