APV art. 2.1.5.1 (Voorwerpen op of aan de weg) is a general rule without a vergunning: using the road is forbidden only when the use damages the road, obstructs the road or its management; an ontheffing of the bevoegd bestuursorgaan is then needed.

Het is verboden de weg of een weggedeelte anders te gebruiken dan overeenkomstig de publieke functie daarvan, als dat gebruik schade … Het bevoegde bestuursorgaan kan ontheffing verlenen van het in het eerste lid gestelde verbod.
