Conditions

APV art. 2:3 (Het plaatsen van voorwerpen op of aan de weg of op andere openbare plaatsen strijdig met de publieke functie ervan) is a general rule without a vergunning: using the road is forbidden only when the use damages the road, endangers the use of the road, obstructs the road or its management, fails reasonable welstand requirements; an ontheffing of the bevoegd bestuursorgaan is then needed.

Het is verboden de weg of een weggedeelte anders te gebruiken dan overeenkomstig de publieke functie daarvan, als: het beoogde gebruik … Het bevoegd bestuursorgaan kan ontheffing verlenen van het in het eerste lid gestelde verbod.
